Terms and Conditons

1.  PAYMENTS (all currencies are in $US)

Booking Deposit:  A Booking Deposit of $200 is required at the time of booking to confirm your reservation.  This amount will be credited towards the final balance.

State & Tourist Tax:  A Florida State & Tourist Tax of 13% will be added to all rental charges.

Cleaning Fee:  A Cleaning Fee of $85 will be charged to all bookings of 6 nights or less.  If applicable to your reservation, this fee will be included in your price quote.

Outstanding Payment:  The Outstanding Payment (this is your Quoted Price, minus the $200 Booking Deposit) is due four weeks prior to your arrival date.  If a booking is made within 4 weeks of the arrival date, the entire Quoted Price will be due at the time of booking.  Payments may be made by check, Visa or MasterCard.  Checks should be payable to MAUREEN RIESCO.

Security Deposit:  A $250 (refundable) security deposit shall be held for all rentals:

If paid by credit card, the card will not be charged until a post-departure inspection is made.  If no "Security Deposit Deductions" (see below) apply, the $250 will never be charged.

If paid by check, the check is due 4 weeks prior to arrival.  The check will be held un-cashed until a post-departure inspection is made.  If no "Security Deposit Deductions" (see below) apply, the $250 check will be voided.

2.  ARRIVAL and DEPARTURE TIMES
Check-in is after 4:00 pmCheck-out is 10:00 am.  This check-out time is strict since cleaners will arrive at the property and must have access.

3.  KEYS and ACCESS
Guests must register at the Windsor Palms Main Gate (guard).  Then, drive to the property and obtain the keys to the home from the lock-box on the wall next to the front door.  The code to this lock-box will be provided to you via email, prior to your arrival.  At departure, please leave the keys in this same lock-box.

4.  LIABILITY/SWIMMING POOL
"A Place In The Sun Homes", its representative(s), the Owners, or Owner's agents DO NOT accept any liability whatsoever for death, personal injury, accidents, loss, or damage to persons or personal effects, however caused, within our property. The property has a swimming pool, and the owners and management company do not accept responsibility in the event of any injury or death caused as a result of the use of the pool.  All children must be supervised at all times by an adult.

5.  POOL HEATING
Our villa has a private swimming pool.  Pool Heating is available at an extra charge, and this must be ordered at the time of booking. The heating system uses an electric heat pump, which relies on an air temperature of 58F.  If for any reason the air temperature falls below this level, the pool will not heat up. The Owners and Management Company cannot be held responsible if this occurs, and no refunds will be made.  Renters MUST NOT tamper with or adjust any of the pool/heating controls.  During the winter months, a pool blanket is provided to help keep the pool as warm as possible.  We ask that guests please use the blanket each night, and when the pool is not in use.

6.  AGE RESTRCTION
Persons under the age of 18 years are not acceptable unless accompanied by a parent or adult.

7.  NO-SMOKING POLICY
There is NO SMOKING permitted anywhere inside the property at any time.

8.  NO-PETS POLICY
There are NO PETS permitted anywhere inside the property at any time.

9.  SECURITY DEPOSIT DEDUCTIONS
We take pride in our home and expect that guests will do likewise and treat the property with respect and care.  There are certain regulations that we MUST adhere to in Florida, and which will ensure that Security Deposit deductions are avoided.  Please read and understand the following - NO EXCEPTIONS:

Damage to Property: Including, but not limited to, stains on carpet & furnishings.

Loss of Property: Including, but not limited to, linens & towels.

Trash Removal: All remaining trash is to be bagged, and placed in the garage at departure. There are two trash collection days each week.  All trash information is displayed on the refrigerator and also in our guest manual.  It is your responsibility to set out the trash for collection.  Failure to do so will result in excessive trash build-up, and incur a $50 charge.

Pets:  Ejection from property and loss of security deposit.

Smoking In The House:  Ejection from property and loss of security deposit (post-departure inspection will reveal traces of tobacco smoke smell).

Occupancy Number:  If the number of occupants exceeds the number listed on the rental agreement, you will be ejected from the property and lose your security deposit.

Tampering with Locked Closets Or Pool Equipment: Loss of security deposit.

Time of Departure: Check-out time is 10:00 AM.  Unauthorized late check-outs will be charged 1 extra night's rental.

Tampering with Pool & Smoke Alarms: This is a violation of Florida law with up to a $5,000 fine.

Placement of Furnishings: All furniture must be left in (or returned to) its original location at departure.  Failure to do so will result in a $50 fine.

Changes to Reservations: Changes to reservations are subject to availability. A $50 fee will be charged if you wish to change homes through our Management Company.

10.  CANCELLATIONS - PLEASE READ CAREFULLY
All cancellations must be made in writing.  Our cancellation policy is as follows:

Cancellations made within 48 hours of our receipt of the $200 Booking Deposit shall be refunded in full (including the $200 Booking Deposit).

Cancellations made after 48 hours of our receipt of the $200 Booking Deposit, and up to 30 days prior to arrival, shall be refunded except for the $200 Booking Deposit.

Cancellations made between 29 days prior to arrival and 15 days prior to arrival shall be charged 50% of the full Quoted Price.

Cancellations made within 15 days of arrival will be charged the full Quoted Price. 

There are no refunds for late arrivals or early departures.

11.  HOUSEHOLD SUPPLIES
This rental property is run on a self-supplying basis. The Management Company provides complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the guest’s responsibility to replenish them for their own use during their stay.

12.  COMPLAINTS/REPAIR REQUEST  
In the unlikely event of any complaint/repair request during your stay, please contact "A Place in the Sun Homes" immediately.  Contact details will be available at the property. "A Place In the Sun Homes" cannot accept complaints after the client's departure.  In the event that "A Place in the Sun Homes" is required to substitute the assigned property, a property of equivalent value will be substituted.

13.  LOCAL REPRESENTATION
As managers of the property, "A Place in the Sun Homes" is here to assist you in making your vacation as enjoyable as possible.  If you have any problems or questions, please ask.  Occasionally it may be necessary for us (or our contractors) to visit the home to perform maintenance or repair work.  Every effort will be made to notify you in advance.

14.  DISRUPTIVE BEHAVIOR
Our home is located in a residential community where all houses are privately owned, and all Guests are subject to the Rules and Regulations of the Homeowners Association.  As such, we will not tolerate behavior that causes a nuisance to our neighbors, or involves acts of violence towards any person or property.  If for whatever reason the Management Company has to get involved in a disruptive event, or if the Police have to be called due to such an event caused by guests at our Property, we reserve the right to have all guests immediately removed, without recourse or financial compensation.

15.  FORCE MAJEUR
The Owners and "A Place in the Sun Homes" shall not be liable for any costs or losses incurred by the guest due to delays or cancellations in the guest's itinerary.  The guest does not have the right to terminate this Agreement for any delay or default that is caused by circumstances beyond the control of the Owners, or "A Place in the Sun Homes". These circumstances include, but are not limited to:  death or illness, acts of God, war, insurrections, government restrictions, natural disasters (earthquakes, hurricanes, floods, etc), riots or other social upheavals, performance failures of parties outside the control of the contracting party (e.g.,disruptions in telephone service attributable to the telephone company or labor actions by employees, etc), or any other cause beyond the reasonable control of the Owners or "A Place in the Sun Homes".

16.  TRAVEL/VACATION INSURANCE
We strongly recommend that all guests consider purchasing comprehensive travel insurance to cover unforeseen circumstances, cancellations, and other non-refundable expenses.

17.  JURISDICTION
This Agreement shall be deemed to have been made in the United States and shall be subject to United States Law. The parties agree to submit to the exclusive jurisdiction of the Courts of the United States of America.
